Gutierrez wins claim against Newcastle

Former Newcastle United midfielder Jonas Gutierrez has won his disability discrimination claim against the Magpies.

Gutierrez claimed that he was left out of the first team after he was diagnosed with testicular cancer in 2013.

Newcastle rejected the player's allegation, saying that he simply was not part of the manager's plans.

The freezing-out meant that Gutierrez failed to reach the required appearances target to trigger a one-year extension to his contract which could have been worth up to £2m.

This afternoon an employment tribunal found that Gutierrez was unfairly treated because of his cancer diagnosis.

Another hearing is now due to be scheduled to determine Gutierrez's compensation.

A further claim that the club failed to make reasonable adjustments for Gutierrez also succeeded, but two other claims of unfavourable treatment and harassment brought by the player failed.
